The French right is full of subtleties that may seem absurd. This is what have seen Antonio Damieta and his companion Manuel de Aguirre, married Spanish couple on 17 February in Spain - where gay marriage is legalized - and residing in France. Asking the Paris prefecture to update their grey card, in order to insure their car, due to change of marital status, they clashed with the categorical refusal of the official, reported release. The reason: where Antonio is Spanish, it is French law which applies and prevails. The France, do not allow marriage between two people of the same sex, cannot recognize their union.
On the other hand, if the two men were Spanish, this is would have any problem to the French administration as L'hexagone recognizes gay marriage of foreign nationals on its soil. This leads to an 'aberration', according to Me Caroline Mécary, counsel for the couple. For her, it's ' reverse discrimination, since foreign nationals enjoy a more favourable treatment than the French nationals. Therefore, would be an "obstacle to the free establishment of nationals of the European Community on the community ground. The matter should be brought to justice soon.
